Supreme Court Justice Sonia Sotomayor will resign despite calls from some on the left that President Joe Biden should try to name a successor before President-elect Donald Trump takes office, officials say. He made it clear that he has no plans to do so.
A source close to the judge said, “She is in excellent health and the court needs her now more than ever.”
Some progressives say Sotomayor, the most senior liberal on the conservative Supreme Court, should resign, giving Biden a short window to nominate a replacement before Trump takes office in January. Suggests. Discussions have been simmering for months over the possibility of the mayor resigning so that Biden can name a successor and ensure the seat remains a reliable vote for liberals, but it has gone nowhere. There wasn’t.
Sen. Bernie Sanders of Vermont said Sunday that he doesn’t think Sotomayor should retire from the court.
“I don’t think that’s wise,” Sanders, an independent who caucuses with Senate Democrats, told NBC’s “Meet the Press.”
The transfer process for Supreme Court nominees takes a considerable amount of time, sometimes lasting several months. Even assuming there are no problems with potential nominees, it is unlikely that there will be enough time for Biden to win confirmation before Republicans take control of the Senate in early January.
Sotomayor, 70, has been open about living with type 1 diabetes and shows little sign of slowing down. She was a persistent questioner during oral arguments and has made repeated public appearances in recent months.
In May, Sotomayor told a Harvard University audience that she sometimes cried after the court handed down its decision. And in January, speaking at the University of California, Berkeley School of Law, Sotomayor said he lives with “frustration” with the court’s direction and that “all the losses are really traumatizing to my stomach and heart.” he said.
“But you have to get up the next morning and keep fighting,” she said.
