Sean “Diddy” Combs is not home for the holidays.
The judge overseeing his sex trafficking and extortion case ruled Wednesday that Combs should remain in prison ahead of his criminal trial in May of this year.
In his ruling, Judge Alan Subramanian said there was “no condition or combination of conditions that would reasonably guarantee the safety of the community” if the music mogul was granted release.
Combs, 55, is currently being held at the Metropolitan Detention Center in Brooklyn.
The news comes days after Combs’ legal team outlined a plan in the event he is released. They said he lives in an apartment on Manhattan’s Upper East Side, has armed security 24/7, and is only allowed to call his attorney and have pre-approved family visits.
However, prosecutor Kristy Slavik argued that releasing Combs from prison would be harmful.
“He has paid to be released from custody and continues to flout the rules. He is a flight risk, a danger to the community, and has attempted to obstruct these proceedings and destroy integrity.” Slavik said during Friday’s hearing.
Prosecutors also alleged that Combs committed witness tampering from behind bars by making three-way calls and using other inmates’ cell phone lines. The defendant also cited an Instagram post he posted earlier this month on his birthday showing his children talking to him on the phone from behind bars, saying he was trying to smear prospective jurors with a PR campaign.
